FPE opposes this bill because it seeks to unjustly change the “Presumption” and various provisions of FSS 112.15 – Heart/Lung Bill

GENERAL BILL by Costello

Public Employees: Revises conditions under which certain special risk employees who suffer or have died from specified medical conditions are presumed to have been injured or killed accidentally & in line of duty; revises conditions under which presumption with respect to disability due to any of specified diseases is against occurrence in line of duty for purposes of workers’ compensation claims; provides medical conditions or behaviors that are appropriate for consideration in denying or overcoming presumption of accidental disability or death suffered in line of duty for police officers & firefighters; changes evidentiary standard; revises definition of “compensation” or “salary” for purposes of firefighters’ & police officers’ pensions; authorizes municipality to change municipal representation of board of trustees pursuant to certain requirements; provides duties of board of trustees relating to reporting of expenses & operation under administrative expense budget; provides process for determining allocation of premium tax revenues to supplemental plan; revises requirements of board relating to employment of legal counsel, actuaries, & other advisers; provides for discontinuation of excise taxes under certain conditions; revises provisions relating to benefits paid from premium tax by municipality or special fire control district that has its own pension plan; revises provisions relating to termination of plans & distribution of funds; provides declaration of important state interest.

HB 903 – Charter Schools

FPE opposes this bill because it seeks to allow Charter Schools to receive State Capitol funding and local Tax Dollars currently received by public school districts.  Without provisions for government oversight, specified usage, and enforcement this Bill further erode much needed Tax Dollars from local districts that will adversely impact public employees.

Charter Schools: Authorizes district school board to share revenue generated by capital outlay millage levy with charter schools on per-student pro rata basis; provides for recalculation of school district’s FEFP allocation if millage levy revenue is not shared & for distribution of recalculated funds; requires payment to charter schools of certain federal funds; revises requirements for designation as high-performing charter school; revises restriction on establishment of new charter schools that replicate high-performing charter schools; authorizes certain activities for high-performing charter school that is part of high-performing charter school system.

State Employment: Revises provisions relating to employment policy of state; revises rulemaking authority of DMS; revises & provides provisions relating to state agencies, ad hoc advisory committees, State Personnel System, state employees, telecommuting, collective bargaining, Select Exempt Service positions, civil service positions, Senior Management Services positions, other-personal-service employment, etc.; provides directives to Division of Statutory Revision; provides penalties; repeals provisions relating to employees of historical commissions, administrative leave for athletic competitions, termination or transfer of certain employees, technical personnel assistance to political subdivisions, family support personnel policies, personnel rules, records, & reports, classification & compensation program for employment positions, shared employment, parental or family medical leave, senior management services & selected exempt service data collections, classification plan & pay bands for selected exempt positions, & certain personnel actions for selected exempt service employees; requires studies & reports by DMS.

CS/SB 2036 – Outsourcing or Privatizing of Agency Functions

FPE opposes this bill because it seeks to opens the door for the outsourcing and/or privatization of  public services, government departments and/or agencies.  It further seeks to eliminate current requirements for public notice of outsourcing and/or privatization without having to justify such action will be more effective than when run by the government agency. This Bill will jeopardize thousands of Public Employees jobs and benefits

Outsourcing or Privatization of Agency Functions; Providing that certain information relating to the outsourcing or privatization of an agency function which is expressly required by law is not required to be included in the agency’s legislative budget request until after the contract for such function is executed; requiring an agency to publicly publish the business case prepared for an outsourcing project on the agency’s website; providing that certain requirements that apply to Department of Corrections’ contracts do not apply to contracts for outsourcing or privatizing the operation and maintenance of correctional facilities which are expressly required by law, etc.

CS/CS/SB 2038 – Privatization of Correctional Facilities

FPE opposes this bill because it seeks to privatize Florida Department of Corrections prison facilities. A action that threatens the jobs of nearly 4,000 Public Employee correctional officers jobs and benefits. It further threatens the security and safety of prison facilities and neighboring communities

GENERAL BILL by Budget; Rules; Rules

Privatization of Correctional Facilities; Requiring that the Department of Management Services, working with the Department of Corrections, privatize the management and operation of certain correctional facilities and assigned correctional units; requiring that the Department of Management Services issue two or more requests for proposals; requiring that the Department of Corrections determine the costs incurred for the 2010-2011 fiscal year for each correctional facility and assigned correctional unit according to a specified formula; requiring that certain accounts associated with the correctional facilities and assigned correctional units continue to be remitted to the General Revenue Fund; requiring that the Department of Corrections prepare and submit to the Legislative Budget Commission proposed revisions to its operating budget, etc.
